2021 BOMA California Legislative Update

In 2021, the California State Legislature introduced over 2,700 legislative measures. The commercial real estate industry tracked 571 of these bills.
Of the 1,204 bills that reached the Governor’s Desk he signed 1,038 and our industry was engaged on a total of 145 of these bills; below is a summary of the more notable bills that made it to the Governor’s desk and some that were stalled out in the process but may come back.

CA Department of Real Estate: Call for Subject Matter Experts

PSI and the California Department of Real Estate (DRE) are recruiting real estate and mortgage licensees to assist with writing new questions for the Salesperson and Broker licensure examinations. 

Commercial Eviction Protection for Nonpayment of Rent Expired September 30

The Oakland City Ordinances on the local commercial eviction moratorium conformed with the Governor’s most recent Executive Order, which expired on Thursday, September 30, 2021. The protections that prevented commercial evictions of small businesses and non-profit organizations for nonpayment of rent ended on that date. Back rent may be due in full depending on the payment plan or other agreement negotiated between the tenant and landlord. The moratorium on residential evictions remains in effect until the end of the Local Emergency as declared by Oakland City Council.

The Building Collapse in Surfside: What You Need to Know

BOMA International released this week a policy brief on the Surfside building collapse.  The frequently-asked-questions document is intended to address some of the issues that have been raised by the network of BOMA local associations.
